1. Our Terms and Conditions

www.surfside22.com.au is a website operated by Surfside 22 Pty Ltd ACN 665 922 270 of 301-303 Keira Street, Wollongong 2500 and our related parties with respect to the Surfside22 Motel located at 22 Crown St, Wollongong NSW 2500 (Motel). 

For these terms and conditions ‘we’ and ‘us’ refers to Surfside 22 Pty Ltd and its related entities. ‘You’ refers to any individual about whom we interact with and in the performance of our services.

You agree to be bound by these terms and conditions which are incorporated on the basis that you make a booking (an offer) which is then accepted by us and in turn, we provide you with a service (Contract). The person making the booking will be deemed to have accepted these terms and conditions on behalf of the guest who will be staying.

Any stay at the Motel or use of any part of the Motel and/or its facilities and services are subject to these terms and conditions.   

To the extent permitted by law, no other terms are implied by trade, custom, practice or course of dealing. The Contract is the entire agreement between you and us with respect to its subject matter. You acknowledge that you have not relied on any statement, promise, representation, assurance, or warranty that is not included in the Contract.

2. Booking 

Our booking process allows you to check and amend any errors before submitting your order to us. Please check the order carefully before confirming it. You are responsible for ensuring that your order is complete and accurate.

After you make your booking, you will receive an email from us acknowledging and confirming your booking (Order Confirmation). At which point the Contract will come into existence. The Contract will relate only to those services confirmed in the Order Confirmation.

Bookings are subject to availability and the applicable pricing at the time of the booking and some conditions/exclusions may apply, including but not limited to minimum stay requirements. If we are unable to supply you with the services for any reason, we will inform you of this by email and we will not process your order.

3. Quotes 

Rates and room availability are subject to change daily. All group rates and room types are quoted based on availability as of the time and date quoted. Additional group terms and conditions are applicable. Verbal quotes are only valid at the time in which they are given and are not valid for making bookings in the future.  

4. Booking Amendments

Guests may request to amend their bookings by contacting the motel's reservation department via phone or email. All requests for amendments are subject to availability and approval by the motel management. An amendment may incur additional charges based on factors such as changes in room type, duration of stay, or other requested modifications. We reserve the right to deny amendment requests. 

If you wish to amend a booking made through third-party booking platforms must be requested through the respective platform or agency and are subject to their terms and conditions.

Any refunds or adjustments resulting from amendments will be processed per our cancellation and refund policy.

5. Cancellation Policy 

Guests may cancel their reservation without penalty up to 7 days before the scheduled check-in time. However, if the cancellation is made within this period a cancellation fee will apply. The cancellation fee will be equivalent to the accommodation fee for 50% of the total booking fee (the greater of the two amounts). 

For no-shows or cancellations within 48 hours, the cancellation fee will be equal to the total booking amount. 

Cancellation requests made through third-party booking platforms must be processed through the respective platform or agency and are subject to their terms and conditions.

During high demand and special event periods, such as Christmas or New Year’s period, extended cancellation policies may apply.

6. General

We reserve the right to refuse service and terminate any reservation where you or your guests breach these terms and conditions, or your reservation does not otherwise meet these terms and conditions. We reserve the right to evict from the Motel any guest that is in breach of these terms and conditions. We will retain 100% of the booking price if you breach these terms and conditions or if you or your guests are evicted from the Motel. 

These terms and conditions apply to all bookings made concerning using, staying and visiting the Motel, and all patrons are subject to the terms and conditions set out below.

No pets or animals are allowed in the Motel complex or rooms at any time.

You will be liable for all damage caused by your or your guests within the Motel and shall bear all costs arising from such damage and/or failure to comply with these terms and conditions. We reserve the right to intervene if necessary and to take any appropriate action against your or your guests.

7. Check In / Check out

(a)Check In

The standard check-in time is 2:00 PM/local time. 

Early check-in requests may be accommodated subject to room availability. Additional charges may apply for early check-in and are at the discretion of Motel management. We work off an auto check-in system. This means check-in to the Motel can be done without a key, we issue you with a one-time check-in code via email or telephone which will allow you access to the Motel.

(b)Check Out

The standard check-out time is 10:00 AM/local time.

Late check-out requests may be accommodated subject to room availability. Additional charges may apply for late check-out and are at the discretion of motel management. Guests are advised to inquire about late check-out options in advance. Unless you have obtained approval for a late check-out, your access code will expire at 10:00 am on the day of your scheduled check-out.

8. Children and Infants

We consider children to be from 4-16 years old (inclusive). Infants are from 0-3 years old (inclusive). Infants can stay at no additional charge if they sleep on existing bedding. If a cot/sofa bed is required additional charges will apply as notified. 

All guests under the age of 18 must be accompanied by a responsible adult, such as a parent, guardian, or another adult who has parental rights and responsibilities for the guest under the age of 18. This responsible adult must be present throughout the stay.

9. Party and Group Bookings 

We have a strict no-party policy. Failure to comply with this policy will result in eviction, and in such cases, management reserves the right to retain the full accommodation fee. As a rule, we ask that all guests keep noise to a minimum after a reasonable time to ensure that other guests and surrounding residents can enjoy a peaceful environment.

10. Housekeeping

To promote environmental sustainability and reduce the carbon footprint associated with daily housekeeping services, we have implemented the following room servicing policy:

  • Rooms will only be serviced for guests staying 3 or more consecutive nights.

  • Daily housekeeping services, including bed linen changes and towel replacements, will not be provided for stays of less than 3 nights. 

  • Guests staying for shorter durations may request specific housekeeping services, such as towel replacement or toiletry restocking, as needed.

This conscious effort to limit room servicing aims to minimize water usage, reduce chemical waste, and conserve energy resources associated with frequent cleaning practices. We appreciate our guests' cooperation in supporting our commitment to environmental stewardship.

11. Smoking 

We are a strictly non-smoking Motel; this includes both cigarettes and e-cigarettes per the Smoke-free Environment Act 2000 and Smoke-free Environment Regulation 2016. This extends to and applies to all areas of the Motel premises. Any patron found smoking may be asked to leave the Motel and will incur additional charges at our discretion, including room cleaning.

12. Parking 

Parking on-site is limited and will be issued on a first-in, best-dressed basis as directed by us. All vehicles are parked at the owners’ risk. We accept no liability or risk for any damage to person or property suffered by you or any guest in the Motel car park. If a vehicle is left in the Motel car park after the guest has checked out from their booking and departed the Motel, without our express consent, we reserve the right to remove the vehicle at the owners’ expense.

Any additional rules of use and occupation we display in the car park from time to time will form part of these terms and conditions. 

13. Valuables 

We will not be held responsible for any monies or other valuables, goods or vehicles which you or your guests bring in or onto the Motel including the rooms, grounds or car park. You remain responsibility for such items and and we will not be responsible for their safekeeping. We take no responsibility for any loss, damage or destruction of property brought in or onto the Motel (whether attended or unattended) by you or any guest. 

14. Swimming Pool and Sauna Areas

Opening hours for the swimming pool and sauna on the Motel will be as published on signage located on the Motel grounds, or as otherwise notified by us or Motel Management from time to time. These hours are strictly enforced and may vary depending on seasonal factors or operational requirements. Specific terms of use for both the swimming pool and sauna will be as published on signage located on the Motel grounds and such terms will form part of these terms and conditions.

15. Facilities and Services 

While care is taken to ensure that the description of our facilities and services is accurate, these are continually being changed, upgraded, and on occasion taken out of service.  If any feature or facility is essential to you in choosing the Motel, it is your responsibility to confirm with us prior to making your reservation that the feature or facility will be available during your stay.  

While we will do everything possible to ensure that the facilities and services are available and ready for use, during your stay, we cannot guarantee that all facilities will be available and will not be liable for omissions, errors or changes to the facilities and services at the Motel, whether temporary or permanent.

You accept full responsibility for the care and treatment of our facilities and services and are used at your own risk. You agree that you are in a fit and proper condition to use our facilities and services and we do not accept any responsibility for any injury or damage. You agree to release, indemnify and hold harmless us, our related entities and our team against any claims, actions or proceedings for any injuries caused to you or others while using our facilities and services. 

You agree to return our facilities and services in the same condition that you originally took the facility or service. If our facilities or services are damaged or is not in the same condition prior to use, you will be liable to pay reasonable costs to reinstate the facility or service to its original condition. You acknowledge and consent for us to use anti-theft technology on our facilities and services to limit any theft that may arise.

You acknowledge and accept that if we deem that you are using our facilities and services in an unsafe or hazardous manner, we may immediately cease your use or participation.
